Corte di Cassazione : lecito affittare a stranieri irregolari se l'affitto risulta equo

Lo chiarisce la Corte di Cassazione sezione I penale nella sentenza 19171 depositata il 7 maggio 2009.

Perchè possa configurarsi il reato di cui all'art. 12, comma 5 bis, del d.lgs. n. 286 del 1998 (che punisce chi, a titolo oneroso, dà alloggio o cede in locazione un immobile ad uno straniero privo del permesso di soggiorno) è necessario il requisito del dolo specifico (costituito dal fine di trarre un ingiusto profitto) il quale non può considerarsi sussistente qualora l'equilibrio fra le prestazioni fra titolare dell'immobile e straniero "irregolare" sia fortemente alterato a favore di quest'ultimo.

Education Minister Dolores Cristina this evening categorically denied rumours that St Paul's Bay primary school - or any other state school in Malta or Gozo, for that matter - would be closed down to house illegal immigrants.

Mrs Cristina was answering a parliamentary question by Nationalist MP Censu Galea.

Mrs Cristina said that she was aware that such rumours were doing the rounds, even with regards to Senglea school and schools in other localities, but there was no truth in them.
